Is it legal to sell a house with asbestos in it?

I was buying a home on land contract and than recently found out that it has asbestos in it. I thought a homeowner had to tell potential buyers about asbestos or is that something you are somehow supposed to know to ask about? Also since they had just had a home inspection done, wouldn't that have been found?
